Dear Ms. Eagan:

This letter provides a follow up our May 1, 2000, letter to you regarding the Adequacy of the Phase II ozone attainment demonstration Motor Vehicle Emission Budgets (MVEB) for the Milwaukee nonattainment area.

As stated in our letter, we have determined that the Milwaukee, Wisconsin ozone attainment demonstration contains adequate MVEB of 31.98 tons/day for volatile organic compounds (VOC) and 78.53 tons/day for oxides of nitrogen (NOx) for the 2007 attainment year. This adequacy finding does not relate to the merits of the State Implementation Plan submittal nor does it indicate whether the submittal meets the United States Environmental Protection Agency’s (USEPA) requirements for completeness or approval of an attainment demonstration.

The USEPA received comments on the December 16, 1999, proposed conditional approval of the Phase II ozone demonstration related to the adequacy of the MVEB. We are in the process of posting our responses these public comments on our adequacy web page located at We will soon publish a notice in the Federal Register announcing this adequacy finding. This finding will not be effective until 15 days after that notice is published.
