Facilities regulated under the final 316(b) New Facility Rule are new greenfield and stand alone electric generators and manufacturing facilities that operate a new cooling water intake structure (CWIS) (or a CWIS whose design capacity is increased), require a National Pollutant Discharge Elimination System (NPDES) permit, have a design intake flow of equal to or greater than two million gallons per day (MGD), and use at least 25 percent of their intake water for cooling purposes.
