Part 71 Air Operating Permits

PART 71 APPLICABILITY

  • Any major source
  • Solid Waste Incineration Units
  • Certain sources subject to requirements under the acid rain program
  • Any source subject to section 111 of the Clean Air Act
  • Any source subject to section 112 of the Clean Air Act
* Some non-major section 111 or 112 sources may be exempt from the Part 71 Program * The effective date of Part 71 program will trigger section 112(g) program covering construction and reconstruction of major sources of HAPS In the absence of an EPA approved Tribal Program on March 22, 1999, sources became subject to the Federal operating permits program and will submit permit applications to EPA by September 22, 1999. EPA is expected to issue one-third of the permits during the first year of the program. Tribes may request that EPA issue permits sooner. Tribes may negotiate an agreement with EPA whereby EPA coordinates permit issuance with the Tribe. Any level of Tribal involvement can be negotiated. Tribes may negotiate delegation of the Part 71 program to the Tribe.
