Dear Mr. Baxter:

This letter provides the United States Environmental Protection Agency's (USEPA) comments and recommendation regarding the air quality requirements for amendments #1 and #3 to the Northwest Indiana 1999 - 2003 Transportation Improvement Program (TIP).

The Northwest Indiana Regional Planning Commission (NIRPC) adopted amendments #1 and #3 on March 18, 1999, and September 23, 1999, respectively. NIRPC provided final documentation on December 20, 1999. The United States Department of Transportation requested comments on both of the amendments via electronic mail on January 28, 2000.

Amendment #1 and amendment #3 each contain only one non-exempt capacity expanding project. Even though the projects are new to the TIP, they are being constructed in the timeframe that NIRPC envisioned in the long range plan. The modeling that was done for the long range plan to ensure that the plan will not have a negative affect on air quality remains valid. Based on this consistency with the conformity modeling for the long range plan, USEPA can recommend conformity for TIP amendments #1 and #3.

In summary, USEPA recommends that the Department of Transportation find that amendments #1 and #3, adopted on March 18, 1999, and September 23, 1999, respectively, by the NIRPC Transportation Policy Committee, conform to the State Implementation Plan for air quality.
