Background

Pursuant to 40 CFR 124.19(d), Region 10 of the United States Environmental Protection Agency is proposing to reissue certain portions of National Pollutant Discharge Elimination System Permit No. AK-003865-2, which the Region issued to Teck Alaska Incorporated on January 8, 2010 (“2010 Permit”). EPA is proposing this action to address five effluent limitations (lead, zinc, selenium, WAD cyanide and total dissolved solids) that EPA withdrew from the 2010 Permit on March 17, 2010.

Tentative Determination

We have tentatively determined to reinstate the limitations for total dissolved solids and WAD cyanide from the 2010 Permit and apply the limitations of the 1998 permit for lead, selenium, and zinc.

State Certification

This Notice serves as Public Notice of ADEC’s CWA 401 Certification for the permit providing that the subject general permit complies with the applicable provisions of Sections 208(e), 301, 302, 303, 306 and 307 of the CWA. The proposed limitations will not be issued until the certification requirements of CWA 401 relating to those limits have been met.

Public Comments

Persons wanting to comment on the five effluent limitations proposed or request that a public hearing be held, may do so in writing to EPA Region 10, Office of Water and Watersheds OWW-130, 1200 Sixth Avenue, Suite 900, Seattle, WA 98101 or via email to godsey.cindi@epa.gov by May 25, 2011. Comments on any other permit conditions will not be considered. A request for a public hearing should name the issues raised as well as the requester's name, address and telephone number. All comments should include the name, address and telephone number of the commenter and a concise statement of the exact basis of any comment and the relevant facts upon which it is based.
