Summary

We are proposing to reissue a general permit (permit) for concentrated animal feeding operations (CAFOs) in the State of Idaho, including CAFOs located in Indian Country. As proposed, all animal feeding operations (AFOs) that meet the regulatory definition of a CAFO, discharge or propose to discharge into waters of the U.S. located in the State of Idaho, including water bodies in Indian Country, and are subject to 40 CFR Part 412 are eligible for coverage under the permit.

Tentative Determination

We have tentatively determined to reissue the permit.

State Certification

Before the permit is finalized, the Idaho Department of Environmental Quality (IDEQ) will have the opportunity to certify the permit under Section 401 of the CWA, 33 U.S.C. 1341. IDEQ may, as a condition of final certification, require that the proposed permit include more stringent limitations or monitoring requirements needed to comply with the CWA or State law. We are required to include any such limitation or requirement in the final permit.

Public Comments

Comments must be received in writing by January 19, 2010, to be considered in the formulation of final determinations regarding the permit. All comments should include the name, address, and telephone number of the commenter, a comment, and the relevant facts upon which it is based. All written comments and requests should be submitted to the attention of the Director, Office of Water and Watersheds, 1200 Sixth Avenue, OWW-130, Seattle, WA 98101. Comments may also be submitted via email to peak.nicholas@epa.gov.

Public Hearings

Written comments receive as much consideration as oral comments at a public hearing. Persons wishing to request a public hearing should submit their written request by January 19, 2010 stating the issues to be raised as well as the requester’s name, address and telephone number to Nicholas Peak at the address above. If a public hearing is scheduled, notice will be published in the Federal Register, will be posted on our web site, and will be mailed to all interested persons receiving notice of availability of the draft permit.
