has applied to the United States Environmental Protection Agency Region 10 (EPA) for approval of its Industrial Pretreatment Program pursuant to the Clean Water Act (Act), 33 U.S.C. § 1251 et seq., and its implementing regulations at 40 CFR Part 403. This Notice is being given in accordance with 40 CFR §§ 403.8(f) and 403.11(b).
The City has requested approval of its Industrial Pretreatment Program. The City’s submission consisted to the Source Control Program Manual and the Source Control Development Report. EPA is tentatively proposing to approve the City’s Industrial Pretreatment Program.
A final determination with respect to the application will be made after consideration of any comments received and/or the record of the public hearing, if held, in accordance with the requirements of the Act and regulations promulgated there under. EPA has 90 days from the date of this notice to review these portions of the submission to determine compliance with the requirements of 40 CFR § 403.8(f), unless the review period is extended as provided for in the regulations.
Interested persons may submit written comments no later than March 28, 2008, on the proposed pretreatment program to the:

All comments should include the name, address, and telephone number of the commenter and a concise statement of the exact basis of any comment and relevant facts upon which it is based. All written comments submitted during the 30-day comment period will be considered by the EPA in making its final decision to approve or deny the applicant’s request for approval of the proposed pretreatment program. The period for submitting comments may be extended if the public interest warrants.
Within 30 days of the date of this Notice, the Applicant, any affected state, or federal agency, person or group of persons may request a public hearing with respect to the proposed pretreatment program. Any such request must meet the requirements of 40 CFR § 403.11(b)(2) and be submitted to the address cited above. If the EPA finds there is a significant degree of public interest in the Applicant’s proposed pretreatment program, a public hearing may be held. If a public hearing is held, the public comment period in this notice shall automatically be extended to the close of the public hearing.
If no comments to this Notice are received, the proposed pretreatment program will be approved as set forth herein without changes and without further public notice. In such event, this notice shall constitute the “notice of approval” required by 40 CFR § 403.11(e) and no additional notice shall be provided. Anyone who wishes to be sent a notice of the final approval of the pretreatment program should send a request for such notice to EPA.
