On February 4, 2011, the U.S. Environmental Protection Agency (EPA) received a request from the U.S. Fish and Wildlife Service (USFWS) to extend the public comment deadline for the proposed reissuance of the National Pollutant Discharge Elimination System (NPDES) permit. EPA agrees that an extension is warranted and hereby extends the comment period for an additional 30 days, from February 7, 2011 to March 9, 2011.

On June 29, 2006, EPA proposed to reissue an NPDES permit which authorizes discharge of wastewater from the Leavenworth National Fish Hatchery, an existing facility that has been in operation since 1941. The previous permit had been issued in 1974. This draft permit updates that permit, incorporating requirements from Ecology’s 401 certification, EPA-approved total maximum daily loads, revised water quality standards, and EPA’s issuance of an NPDES general permit for federal and tribal aquaculture facilities in Washington State. This permit establishes effluent limitations, best management practices, monitoring and reporting requirements that are protective of the quality of the receiving waters (Icicle Creek).

Tentative Determination

The Region 10 Office of EPA has tentatively determined to issue the permit.

State Certification

The Washington Department of Ecology (Ecology) provided water quality certification for this permit under the provisions of Section 401 of the Clean Water Act on January 7, 2010. Provisions of that certification have been incorporated into this revision of the draft permit.

Public Comments

Persons wishing to comment on the tentative determinations contained in the draft permit may do so in writing to the above address to the attention of the Director, Office of Water and Watersheds or by e-mail to wilson.sharon@epa.gov by close of business on March 9, 2011. All comments should include the name, address, telephone number, and e-mail address, if applicable, of the commenter and a concise statement of the exact basis of any comment and the relevant facts upon which it is based. Comments must be received by the closing date to be considered in the formulation of final determinations regarding the application.
