Alaska's NPDES Authorization

On October 31, 2008, EPA Region 10 approved the application by the State of Alaska to administer and enforce an Alaska version of the National Pollutant Discharge Elimination System (NPDES) program pursuant to Section 402 of the Clean Water Act. The State administers the approved Alaska Pollutant Discharge Elimination System (APDES) program through the Alaska Department of Environmental Conservation (ADEC). The EPA-approved implementation plan transfers administration of specific NPDES program components from EPA to the State over a three year period from the date of program approval, subject to continuing EPA oversight and enforcement authority.
