Alaska's NPDES Authorization Process

EPA Region 10 has responsibility for administering the NPDES program for the State of Alaska, including issuing and enforcing wastewater discharge permits. The State is currently in the process of developing NPDES program elements for submittal to EPA for approval. On August 27, Governor Frank Murkowski signed the law directing the state Department of Environmental Conservation to submit an application to EPA by July 1, 2006. See the 8/27/05 press release.Exit EPA disclaimer. Once EPA approves the proposed program, authority to administer the NPDES program will be delegated to the State.

On July 5, 2006 the Administrator received the State of Alaska's NPDES Authorization Application. The State's program submission consists of the following program elements: Governor's Letter; Attorney General's Statement; Statutes and Regulations; Program Description; Memorandum of Agreement; and Continuing Planning Process document. State NPDES programs are authorized by §402(b) of the Clean Water Act, 33 U.S.C. §1342(b). Alaska's NPDES program application will be reviewed by EPA for completeness and approvability under §402(b),(c) and (n) of the Clean Water Act, 33 U.S.C. §1342(b),(c) and (n); 40 CFR Part 123; and other applicable statutes and regulations.
