Description: A generator is not required to recycle either characteristic or nonhazardous used oil. EPA presumes used oil wil be recycled and managed under Part 279 until disposed or sent for disposal (SEE ALSO 57 FR 41566, 41578; 10/10/92). A generator disposing or sending for disposal used oil that exhibits a characteristic of hazardous waste must manage the used oil in accordance with RCRA Subtitle C. A generator disposing or sending for disposal used oil that is nonhazardous must manage the used oil in accordance with RCRA Subtitle D. Used oil must be managed according to Part 279 provisions until it is actually disposed of or sent off site for disposal. There is no limit on the amount of time used oil generators can accumulate used oil on site before sending it for recycling or disposal.
