Description: In the RCRA statue, EPA temporarily excluded certain large-volume coal combustion wastes from being regulated as hazardous waste, pending completion of a regulatory determination. In 1993, EPA determined that fly ash, bottom ash, boiler slag, and flue gas emission control dust from coal burning utilities did not warrant regulation as hazardous waste (SEE: 58 FR 42466; 261.4(b)(4)). In 2000, EPA concluded that the remaining coal combustion wastes did not warrant regulation as hazardous waste. However, EPA also determined that national nonhazardous waste regulations were appropriate for CCW disposed in surface impoundments or used as fill in surface or underground mines (SEE: 65 FR 32214). This determination was based on (1) the constituents present in these wastes include toxic metals, (2) there were 11 documented cases of proven dangers from improper management of these wastes in landfills and surface impoundments, (3) lack of controls, such as liners and groundwater monitoring, and (4) gaps had been identified in state oversight
