EPA Settles Alleged Violations of Underground Storage Tank Regulations with Baltimore Company - Consent Agreement Covers 32 Maryland Facilities Owned by Carroll Independent Fuel Co.

PHILADELPHIA – In a consent agreement with EPA, Carroll Independent Fuel Co. has agreed to pay a $284,156 civil penalty and complete a special environmental project to settle an EPA complaint involving underground storage tanks at 32 of its facilities in Maryland.

EPA cited Carroll for a variety of underground storage tank (UST) violations including failure to perform release detection, failure to test the operation of the line leak detectors annually, failure to meet the new UST system performance standards for spill and overfill prevention, failure to provide corrosion protection on the metal piping, failure to investigate a suspected release, failure to report a suspected release, and failure to perform lint tightness testing.

These alleged violations were documented through multi-facility underground storage tank compliance audit reports submitted to EPA by Carroll’s auditor after Carroll entered into a consent agreement and final order in June 30, 2003 to perform a compliance audit of its facilities.

“This has been a win-win situation because Carroll Independent Fuel Co. recognized that shortcomings existed within its system and volunteered to perform a self audit at its 70 facilities,” said Donald S. Welsh, regional administrator for EPA’s mid-Atlantic region.

As part of the settlement, Carroll Independent Fuel Co. has neither admitted nor denied liability for these violations. Carroll has also agreed to implement a $447,000 supplemental environmental project, to be determined, that is intended to secure significant environmental or public health protections.

With millions of gallons of gasoline, oil, and other petroleum products stroed in underground storage tanks throughout the U.S., leaking tanks are a major source of soil and groundwater contamination.
