2. Draft Permit Modification
EPA is seeking public comment on modifying the NPDES permit issued on June 23, 2009 to the facility referenced above. The draft modification deletes the
following permit condition, which applies to Outfall 004:

TO DISCHARGE TO WATERS OF THE UNITED STATES,
Part I.B.2: “Discharges of process water such as dust suppression water and stormwater from Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) Cleanup actions are prohibited from Outfall 004.”
CHPRC challenged this condition in a petition for review filed with EPA’s Environmental Appeals Board on July 23, 2009. In accordance with federal regulations, EPA subsequently issued a notification withdrawing the condition, effective September 29, 2009, and stating EPA’s intent to seek public comment on removing the condition from the permit. All other conditions of the permit became effective on September 22, 2009 and are not subject to further comment or appeal.
Upon review and analysis, EPA has determined that Part I.B.2 may appropriately be deleted from the permit. Prior NPDES permits issued to this facility contained no similar provision.
CHPRC does not contest the monitoring of radionuclides gross alpha, gross beta and cesium 137 as required for Outfall 004 in Table 1 of Condition I.B. The monitoring, recording and reporting requirements included in the permit for radionuclides will not be modified. A Fact Sheet is available.
3. Tentative Determination
The Region 10 Office of the EPA has tentatively determined to issue a permit modification deleting Part I.B.2 from Permit No. WA-002591-7.
4. Public Comments
Persons wishing to comment on the tentative determination described above or wishing to request that a public hearing be held, may do so in writing, within 30 days of the date of this public notice. A request for a public hearing shall state the nature of the issues to be raised as well as the requester's name, address and telephone number. Comments must be received within this 30-day period to be considered in the formulation of final determinations regarding the modification. All comments should include the name, address and telephone number of the commenter and a concise statement of the exact basis of any comment and the relevant facts upon which it is based. All written comments and requests should be submitted to EPA at the above address to the attention of the Director, Office of Water and Watersheds.
5. Administrative Record
The draft NPDES permit modification and other related documents are on file and may be inspected at the above address any time between 8:30 a.m. and 4:00 p.m., Monday through Friday.
