Background

EPA is proposing to modify the NPDES permit to Alyeska Pipeline Service Co. for the Valdez Marine Terminal, located in Valdez, Alaska. The current permit (reissued October 30, 2012) authorizes discharges from the ballast water treatment plant (Outfall 001) and the sanitary wastewater treatment plant (Outfall 002) to Port Valdez.

Following issuance, Alyeska sought review of the Whole Effluent Toxicity (WET) provisions in the permit as part of the Environmental Appeals process. EPA agreed to modify the permit and is seeking public comments on those modified conditions, which include: removing acute WET testing, removing the lower trigger for chronic toxicity, expanding the chronic WET testing dilution series, modifying the chronic WET testing frequency, and incorporating language regarding sample holding times.

Tentative Determination

EPA Region 10 Office has tentatively determined to modify the Alyeska Pipeline Service Co. Valdez Marine Terminal permit as described in the “Summary” section above.

Public Comments and Hearing Requests

Persons wishing to comment on the tentative determinations contained in the proposed permit modification and fact sheet, may do so in writing, within 30 days of the date of this public notice. Pursuant to 40CFR122.62 only the conditions subject to modification are reopened for public comment. Comments must be postmarked by August 9, 2013, to be considered in the final determination on the permit. All comments must include the commenter’s name, address and telephone number and a concise statement of the exact basis of any comment and the relevant facts upon which it is based.
