State of Idaho Revised Authorization Application
The State of Idaho has applied for final authorization to revise its hazardous waste program under the Resource Conservation and Recovery Act (RCRA). The State’s hazardous waste program was initially approved on April 9, 1990, and subsequently, several State program revisions have been approved. The State of Idaho’s current program revision application is to revise its authorized hazardous waste program to include all delegable Federal regulations codified as of July 1, 2003. This includes all delegable regulatory changes to the Federal hazardous waste program promulgated between July 1, 2001 and July 1, 2003, as well as the remaining portions of the October 22, 1998 Federal rule “Standards Applicable to Owners and Operators of Closed and Closing Hazardous Waste Management Facilities: Post-Closure Permit Requirement and Closure Process; Final Rule” (63 FR 56710) that were not previously authorized.
States with final authorization under Section 3006(b) of the RCRA, 42 U.S.C. 6926(b), have a continuing obligation to maintain a hazardous waste program that is equivalent to, consistent with, and no less stringent than the Federal hazardous waste program. The EPA has reviewed Idaho’s application and has preliminarily determined that its hazardous waste program revision satisfies all of the requirements necessary for final authorization. The public may submit written comments on EPA’s proposed rule during the public comment period which ends 30 days after the date of publication of the proposed rule in the Federal Register. All written comments should be sent to:
